Terms of Service
1. Acceptance of Terms
By creating an account or using Inmigrante.Help (the "Service"), you agree to these Terms of Service. If you do not agree, do not use the Service. We may update these terms at any time; continued use after changes constitutes acceptance.
2. Description of Service
Inmigrante.Help is a bilingual (English/Spanish) organizational tool that helps immigrant families manage health records, immigration documents, medications, appointments, finances, and emergency contacts. The Service is provided by Smith Medical, P.C.
3. Not Legal or Medical Advice
Inmigrante.Help is an organizational tool ONLY. We do NOT provide legal advice, medical advice, immigration counsel, or tax guidance. Information provided by our AI features is for organizational purposes only and should not be relied upon as professional advice. Always consult a licensed attorney, physician, or tax professional for legal, medical, or financial decisions.
4. Account Registration
You must provide accurate, complete information when creating an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You must be at least 18 years old to create an account. Parents or guardians may manage accounts on behalf of minors in their family.
5. Subscription Plans and Billing
Inmigrante.Help offers free and paid subscription plans. Paid plans (Esencial and Familia) are billed annually. All paid plans include a 14-day free trial. You will not be charged until the trial period ends. You may cancel at any time through the Manage Billing portal in Settings. Upon cancellation, you retain access until the end of your current billing period. Refunds are not provided for partial billing periods. Upgrades from Esencial to Familia are prorated — you only pay the difference for the remaining billing period. Prices are in US Dollars and may be updated with 30 days advance notice.
6. Acceptable Use
You agree not to: (a) use the Service for any unlawful purpose; (b) upload malicious code, viruses, or harmful content; (c) attempt to gain unauthorized access to other accounts or systems; (d) use the Service to harass, abuse, or harm others; (e) resell, redistribute, or commercially exploit the Service without written permission; (f) use automated tools to scrape or extract data from the Service.
7. User Content and Data
You retain ownership of all data you enter into the Service (health records, documents, financial information, etc.). By using the Service, you grant us a limited license to store, process, and display your data solely to provide the Service. We do not sell your data. 8. AI Features Disclaimer
Our AI-powered features (chat assistant, health summaries, appointment prep, care plan generator, immigration timeline, document translation) use artificial intelligence to generate suggestions and content. AI outputs may contain errors or inaccuracies. You should always verify AI-generated information independently. AI features do not constitute professional advice. We are not liable for actions taken based on AI-generated content.
9. Emergency Features Disclaimer
The panic button feature sends SMS alerts to your designated emergency contacts with your GPS location. This feature is not a substitute for calling 911 or local emergency services. We do not guarantee SMS delivery, as it depends on third-party carriers and services (Twilio). Always call emergency services directly in life-threatening situations.
10. Third-Party Services
The Service integrates with third-party providers including Stripe (payments), Convex (database), Anthropic (AI), Twilio (SMS), Resend (email), and Google Maps (resources). Your use of these integrations is subject to their respective terms of service. We are not responsible for the availability, accuracy, or conduct of third-party services.
11. Intellectual Property
The Service, including its design, code, logos, and content (excluding user data), is owned by Smith Medical, P.C. and protected by copyright and intellectual property laws. You may not copy, modify, distribute, or create derivative works without written permission.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SMITH MEDICAL, P.C. AND INMIGRANTE.HELP SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, REVENUE, OR PROFITS. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE CLAIM. The Service is provided "as is" without warranties of any kind, express or implied.
13. Indemnification
You agree to indemnify and hold harmless Smith Medical, P.C., its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.
14. Termination
We may suspend or terminate your account if you violate these Terms. You may delete your account at any time by contacting hola@inmigrante.help. Upon termination, your data will be deleted within 90 days in accordance with our Privacy Policy.
15. Governing Law
These Terms are governed by the laws of the Commonwealth of Pennsylvania, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Delaware County, Pennsylvania.
